Received Stamp 4 two weeks ago and wants to get the spouse from India

Post by ambilyjose1 » Thu Apr 20, 2017 9:30 am

Hi There,

Hoping someone could assist me.
I recently got my stamp 4 (I was on Critical Skills for for 2 years)
I would like to get my husband here in Ireland.
I went through the website but its quite confusing, can you please advise if i can apply for him straight away or I have to wait for 1 year then apply fro the spouse visa.
If i could then do I apply from here or does he need to apply from India. And what kind visa will i be applying for him.

I would really appreciate a reply.

thank you so much.

regards,
Ambily

Your spouse can apply for visa straightaway. There is no need to wait. Your spouse has to apply from India but you have to send your documents to your spouse. Your spouse has to apply for Join Family visa

Hi Zeno,

Many Thanks for your reply.
I have one more question.
The "Policy Document on Non-EEA Family Reunification" says that all Stamp 4 has to wait for 12 months to apply for spouse visa.
Category B (Eligible to sponsor applications for family reunification after
12 months)
 Non Critical Skills Employment Permit Holders
 All Stamp 4 holders not covered by other more
favourable arrangements
 Ministers of Religion (there is a case for putting these
in cat A provided they are maintained by the
church)

Can you please clarify this to.

Thanks again for your help,

regards,
Ambily

I have read the document. It says immediate family reunification is possible when you have critical skills employment Permit (CSEP). So, you were eligible 2 years back to immediately bring your Spouse to Ireland. Are you saying because you have upgraded from CSEP to stamp4 now that your right to bring your Spouse has reduced? It sounds illogical, isn't it? You have a sound history now in this country. They should trust you more now. You are working here and paying tax. Remember your Stamp4 is based on CSEP, so you should be eligible. There may be many ways to get Stamp4 and those cases may be different from yours. I suggest you ask your Spouse to apply for visa immediately. That document was written based on a history of recession which Ireland faced for long. I don't think economic scenario is bad now, on which that text was based on, that you are referencing.

Anyways I will get him to apply soon.

Thanks for your help in this.

Hello Ambily,

I'm in the same situation as yours. What was the outcome of your husband's VISA application. How long did the embassy take to process it.
Appreciate for any specific tips/inputs.

Thanks...

Hi Zeno,

I had all the documents ready to apply for my husband, but i have been made redundant from the company that gave me my initial sponsorship for CSWP.
I have already got a new job. I finished at old job on June 30 and started my new job on July 3rd.
Can you advise if its better to wait three months and get the 3 payslips from current employer or submit it now with old employer's payslips and explain in the letter what happened? the new job is not permanent though.
I'm so confused now .

Thank you in advance for your help.

Hi Melorith,

I'm in exactly the same situation as yours. Did you manage to get Join Spouse Visa?
If yes, how long did it take?

Thanks.

Hi All,

I am due to receive my stamp4 and I am getting married in the month of October. Will we able to apply for dependant visa immediately??. From the posts I can see that since I have served in Stamp1 for 2 years, I can consider applying right away. If so, what would be the processing time?, how long should we wait until we receive the dependant visa?.

Please any help would be much appreciated.

Thanks in advance,

You can apply for the visa after changing Stamp4. My Stamp4 dependent application was processed in Dublin and visa issued on New Delhi. It took three months for me to get the visa for my family. But I've applied in January. Not sure about the current processing time.
